HOME FREE Official Rules: May 5 – August 2, 2008

1. The HOME FREE Home is located at 5987 Woodland Park Court, Columbus, IN. It will consist of a single family residential dwelling on a lot measuring 62 by 114 feet, more or less, and is identified as Lot 1 of the Lincoln in Woodland Park subdivision.

2. You must be 18 years of age and an Indiana resident to be eligible to participate. Photo identification will be required in order to qualify as a Key Finalist. This contest will be in two parts. Once you register to enter the contest, you will be eligible, by one of the processes described in Rule #5 below to qualify as a Key Finalist. Key Finalists will be eligible to win the HOME FREE Home on August 2, 2008.

3. If you qualify as a Key Finalist, you must be present at the HOME FREE Home at 5987 Woodland Park Court, Columbus, IN on August 2, 2008 at 9:30 a.m. in order to be eligible to win the HOME FREE Home. Those Key Finalists present at the HOME FREE Home will be issued a single key. One of the issued keys will fit the lock on the front door of the house. The Key Finalist whose issued key fits the door lock will be the winner.

4. You may register your entry to become a Key Finalist at the Skaggs Builders, Inc. model home located at 5930 Shellbark Court at Lincoln in Woodland Park (not to be confused with the HOME FREE Home). You may also register by Website registration (see rule 5 below); by U.S. Mail; by the On-Air Giveaways during regular programming on WCSI, WKKG, 104.9 The River, and Y106 when announced; or by Live Key Stop Broadcasts (remote broadcast events; see rule 5 below).

5. Website or US Mail registration for entry to become a Key Finalist will take place from May 5, 2008 through and 11:59 PM on July 28, 2008 only. You may go to the HOME FREE page on any of our sites and register (wcsiradio.com, wkkg.com, 1049theriver.fm and y106.com) or by mail postmarked May 5 through July 28, 2008 (addressed to: White River Broadcasting Company, HOME FREE Registration, PO Box 1789, Columbus, IN 47202-1789.) If you enter by mail, the mail entry must be received by White River Broadcasting Company not later than July 30, 2008. The Live Key Stop Broadcasts will take place at various locations in the listening area from May 12 through July 28, 2008. For dates and times, check the HOME FREE page on the websites referenced here for the Live Key Stop Broadcast schedule. Registration at the Skaggs Builders model home will take place between April 1, 2005 and July 28, 2008 during normal business hours only. Time is of the essence. Neither Skaggs Builders, Inc. nor White River Broadcasting Company will be responsible for the failure to receive any mail or web entries due to delays, electronic failures or for any reason whatsoever.

6. You may register to become a Key Finalist by any of the above methods. You may register multiple times, but each contestant who becomes a Key Finalist can qualify for only one (1) key.

7. A total of Two Hundred and Ten (210) keys will be awarded to HOME FREE Home Key Finalists. Of these, Thirty Six (36) will be issued to eligible entrants via registration at the Skaggs Builders, Inc. model home; Twenty (20) will be issued to eligible entrants via Website registration and U.S. Mail; Forty (40) will be issued via On-Air Giveaways; and One Hundred and Fourteen (114) will be issued via Live Key Stop broadcasts. The winner of the HOME FREE Home will be selected from the Key Finalists by the procedure described in these Rules.

8. The HOME FREE Home is subject to all covenants and restrictions of the Lincoln in Woodland Park subdivision; any and all applicable government land use or zoning restrictions; any permitting or subdivision regulations, and ordinances and statutes of record. No warranty or representation is made with respect to the metes and bounds of the lot, or the area or size of the lot, or any survey that may or may not have been done with respect to it; any environmental issues that may be associated with the lot; its value; or its fitness for any particular purpose or use.

9. The winner of the home shall be responsible for paying all applicable income taxes. An IRS Form 1099-MISC will be issued to the winner of the house by Skaggs Builders, Inc. The estimated value of the Home is $140,000 - $160,000, but the winner may not rely on this estimate for any purpose, or make any representations to third parties concerning that estimate.

10. Winners will be required to sign an IRS Form W-9 or equivalent.

11. Deed recording charges and closing costs to acquire the home shall be the sole responsibility of the HOME FREE Winner. Skaggs Builders, Inc. will pay the Spring installment of Real Estate taxes due and payable in May 2008 and the HOME FREE Winner will be responsible for the payment of all future Real Estate taxes and all other taxes, costs, fees, and expenses related to the maintenance of the house and property commencing as of the date the HOME FREE Winner accepts the prize. Title insurance and homeowner’s hazard and liability insurance shall be the sole responsibility of the HOME FREE Winner. Taxes are estimated at approximately $1800 per year.

12. Skaggs Builders, Inc. will provide the standard Lincoln in Woodland Park subdivision warranty to the winner of the home. No other representations or warranties are made whatsoever, and in all respects, the residence and the property are conveyed AS-IS, WHERE-IS.

13. There will be only one winner chosen. The winner has the right to forfeit the prize, take possession or gift the home to someone who is not in our non win category described in these rules. The winner will have no recourse whatsoever against Skaggs Builders, Inc., White River Broadcasting Company, Inc., any advertising agencies or other media outlets, nor any employees, agents or principals of any of the said entities..

14. Employees or families (spouses, parents, siblings, children and each of their respective spouses) of Skaggs Builders, Inc., White River Broadcasting Company, advertising agencies and other media outlets are ineligible.

15. No purchase is necessary in order to enter; to become a Key Finalist; or to win the HOME FREE Home.

16. Only One (1) home will be given away by WCSI, WKKG, 104.9 The River, Y106, also collectively known as White River Broadcasting Company and Skaggs Builders, Inc.

18. Participants are required to provide truthful information on entry registration forms. Skaggs Builders, Inc. and White River Broadcasting Company will reject and delete any entry that either discovers to be false or fraudulent.

19. This contest is subject to all applicable federal, state and local laws and regulations.

20. Failure to comply with these contest rules, or any of them, will result in a contestant’s disqualification and forfeiture of any prize.

21. All decisions of station management of White River Broadcasting Company, and of Skaggs Builders, Inc. are final.

22. By participating in this Contest, the winner agrees to have his or her name, voice or likeness used in any advertising or broadcast promotional material relating to this Contest without additional financial or other compensation or consideration, and without signing any further publicity release prior to airing.

23. Prize winners agree to hold harmless, release and indemnify Skaggs Builders, Inc. and White River Broadcasting Company, its corporate licensee, The Findlay Publishing Company, officers, directors and shareholders thereof and affiliated entities from any and all loss, claim, injury, damage or expense, including, but not limited to reasonable attorney’s fees and costs, which are in any way connected or associated with the use or ownership of any prize or prizes received from Skaggs Builders, Inc. and/or White River Broadcasting Company.
